Ook het <a href=\"https:\/\/www.eccbelgie.be\/nieuws\/2023\/xpendy\" target=\"_blank\" rel=\"noreferrer noopener\">Europees Centrum voor de Consument<\/a> (ECC) en de <a href=\"https:\/\/www.consumentenbond.nl\/nieuws\/2023\/opzeggenbij.nl-en-xpendy-informeren-onvoldoende\" target=\"_blank\" rel=\"noreferrer noopener\">Consumentenbond<\/a> waarschuwen voor deze partij. Wij willen consumenten informeren, waarschuwen en ons zoveel mogelijk distanti\u00ebren van deze praktijken. Daarnaast onderzoeken we juridische stappen om Xpendy te stoppen.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Gebrek aan transparantie over betalingsverplichting<\/h3>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.sepastop.eu\/blog\/wp-content\/uploads\/2023\/05\/Firefox_Screenshot_2023-05-08T06-45-04.992Z.png\" alt=\"\" class=\"wp-image-2972\" width=\"249\" height=\"325\" srcset=\"https:\/\/www.sepastop.eu\/blog\/wp-content\/uploads\/2023\/05\/Firefox_Screenshot_2023-05-08T06-45-04.992Z.png 324w, https:\/\/www.sepastop.eu\/blog\/wp-content\/uploads\/2023\/05\/Firefox_Screenshot_2023-05-08T06-45-04.992Z-230x300.png 230w\" sizes=\"auto, (max-width: 249px) 100vw, 249px\" \/><\/figure><\/div>\n\n\n<p>Consumenten schrijven ons dat ze zich <strong>misleid en opgelicht <\/strong>voelen door Xpendy, omdat ze niet op de hoogte waren van de kosten van de dienst. De prijsinformatie is verborgen tussen kleine lettertjes, waardoor consumenten er gemakkelijk overheen lezen. Europese regels verplichten ondernemers om consumenten duidelijk en begrijpelijk te informeren over de aard en prijs van de overeenkomst.<\/p>\n\n\n\n<p>Ook moeten ondernemers volgens Europese regels zorgen dat de <strong>bestelknop <\/strong>waarop consumenten klikken tijdens het aankoopproces, een duidelijke en ondubbelzinnige tekst bevat die aangeeft dat <strong>betaling verplicht<\/strong> is (bijv. &#8216;<em>Nu betalen<\/em>&#8216;, &#8216;<em>Bestelling met betalingsverplichting<\/em>&#8216;)<sup><a href=\"#referenties\">1<\/a><\/sup>.<\/p>\n\n\n\n<p>Het ECC is duidelijk en concludeert<sup><a href=\"#referenties\">2<\/a><\/sup>:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;het vermeende contract tussen u en Xpendy is nietig en u hoeft dus <strong>niets te betalen!<\/strong>&#8220;<\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\">Wat kunt u doen?<\/h3>\n\n\n\n<p>Het ECC geeft duidelijk advies:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Heeft u <strong>al betaald?<\/strong> Doordat de bestelknop niet vermeldt dat betaling vereist is, wordt de overeenkomst als nietig beschouwd. Als u een eenmalige automatische afschrijving van uw bankrekening heeft opgemerkt, neem dan contact op met uw bank om de betaling te betwisten en een terugbetaling te vragen.<\/li>\n\n\n\n<li>Heeft u een <strong>betalingsaanmaning ontvangen?<\/strong> Betaal niet en stuur zo snel mogelijk, het liefst binnen 14 dagen na &#8216;aankoop&#8217;, een <a href=\"mailto:info@xpendy.com\" target=\"_blank\" rel=\"noreferrer noopener\">e-mail<\/a> naar Xpendy om het vermeende contract te betwisten.<\/li>\n\n\n\n<li>Aangezien Xpendy een Nederlands bedrijf is, kunt u het beste een<strong> klacht indienen<\/strong> bij de Autoriteit Consument &amp; Markt (ACM). Doe dit via deze link: <a href=\"https:\/\/www.consuwijzer.nl\/doe-uw-melding-bij-acm-consuwijzer\" target=\"_blank\" rel=\"noreferrer noopener\">klacht melden<\/a>.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Een abonnement om abonnementen op te zeggen?<\/h3>\n\n\n\n<p>Herlees bovenstaande titel gerust. Wij waren eerst ook verbaasd. Wij ontvingen een e-mail van een consument die Xpendy gebruikte (met spijt) en daarnaast <strong>\u20ac4,95 per maand <\/strong>van zijn rekening zag verdwijnen. Mensen die abonnementen willen opzeggen, krijgen op deze manier n\u00f3g een<strong> abonnement aangesmeerd<\/strong>. Dit is niet alleen cynisch, maar ook onwettig. Een incasso vereist een geldige incassomachtiging, die in dit geval ontbreekt.<sup><a href=\"#referenties\">3<\/a>,<a href=\"#referenties\">4<\/a><\/sup><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.sepastop.eu\/blog\/wp-content\/uploads\/2023\/05\/Xpendy-abo-trap-1024x799-1.png\" alt=\"\" class=\"wp-image-2973\" width=\"471\" height=\"367\" srcset=\"https:\/\/www.sepastop.eu\/blog\/wp-content\/uploads\/2023\/05\/Xpendy-abo-trap-1024x799-1.png 1024w, https:\/\/www.sepastop.eu\/blog\/wp-content\/uploads\/2023\/05\/Xpendy-abo-trap-1024x799-1-300x234.png 300w\" sizes=\"auto, (max-width: 471px) 100vw, 471px\" \/><figcaption class=\"wp-element-caption\">&#8220;Honderden euro&#8217;s besparen? Natuurlijk! Een nieuw abonnement? Wat?!<sup><a href=\"#referenties\">5<\/a><\/sup><\/figcaption><\/figure><\/div>\n\n\n<h3 class=\"wp-block-heading\">Wie is Xpendy?<\/h3>\n\n\n\n<p>Xpendy is het handelsmerk van het Nederlandse bedrijf ROI is King Group B.V., met als enige bestuurder en aandeelhouder Yonego Holding B.V., een online marketingbedrijf. Ze lijken echter ook niet trots te zijn op hun eigen praktijken, aangezien ze op hun <a href=\"https:\/\/www.yonego.com\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">website<\/a> nergens melding maken van Xpendy&#8230;<\/p>\n\n\n\n<h6 class=\"wp-block-heading\" id=\"referenties\">Referenties<\/h6>\n\n\n\n<ol class=\"wp-block-list\">\n<li>HvJ EU 7 april 2022, &nbsp;C\u2011249\/21, ECLI:EU:C:2022:269 (<em>Fuhrmann-2-GmbH\/B.<\/em>).<\/li>\n\n\n\n<li>ECC Belgi\u00eb. 28-02-23.
